(Bismarck, ND) — A lawsuit filed alleging the use of excessive force and violation of a man’s civil rights during the Dakota Access Pipeline protests is being thrown out of court. A judge says 24-year-old Marcus Mitchell failed to show that officers treated him any differently than other protesters. Mitchell filed the lawsuit in July, claiming that he faced excessive violence by officers in January 2017 and saying that he suffered long-term vision, hearing and smell problems, and chronic pain.
