(Pierre, SD) — A former judge says he wants to change the state’s death penalty law with newly introduced legislation. Senate Bill 98, presented by state Senator Arthur Rusch, would limit the use of the death penalty to only those directly involved in killing law enforcement or first responders. Rusch, who presided over the first judicial district for 18 years, says his time as a judge has shown him the death penalty does not work as a deterrent and is not always the most effective option. The bill is not a full repeal. Past bills looking to limit the death penalty have not made it very far.
