Judge Rejects Legalized Marijuana Amendment In SD

(Pierre, SD) — A Hughes County judge is rejecting a voter-approved amendment that would legalize recreational marijuana as unconstitutional. Constitutional Amendment A was struck down yesterday on the grounds that it violated the single subject rule. The judge also ruled that the measure conflicted with language that provides for changes in the Constitution. The suit was brought by South Dakota Highway Patrol Superintendent Rick Miller and Pennington County Sheriff Kevin Thom, who argued that the measure should be considered a revision rather than an amendment.
