North Dakota’s Only Abortion Provider Challenging Ban

(Bismarck, ND) — North Dakota’s only abortion provider is challenging the state’s upcoming ban on the practice. The Fargo-based Red River Women’s Clinic filed a lawsuit in state court yesterday, claiming the ban is illegal under the state constitution’s rights of life, liberty, safety, and happiness. The suit also disputes the timing of the ban, which takes effect July 28th based on the 2007 trigger law passed in North Dakota. The lawsuit argues that an official judgment hasn’t been issued yet by the Supreme Court, which would mean the law couldn’t take effect until 30 days after that happens.
