(Pierre, SD) — A judge is denying Governor Kristi Noem’s appeal of the federal government’s Mount Rushmore Fireworks decision. The Eighth Circuit of the United States Court of Appeals rejected Noem’s contention that the denying the permit was unconstitutional. The court ruled that the state didn’t have an innate right to set off fireworks on federal land. South Dakota’s appeal was supported by 16 other states.
