(Black Hawk, SD) — A judge is dismissing a lawsuit against the state in connection with a sinkhole in a Rapid City-area town. Residents of Black Hawk filed suit over the 2020 Hideaway Hills mine sinkhole. The lawsuit claimed the state did not inform residents of the possibility of sinkholes caused by mining activities, including how the mine was closed. The judge said the state has “sovereign immunity” and was doing “what was best for the community.” Attorneys for the plaintiffs reportedly plan to appeal the ruling.
