Summit Carbon must submit a revised CO2 pipeline plan

PIERRE, S.D. (KELO) — Summit Carbon must submit a revised CO2 pipeline plan to the South Dakota Public Utilities Commission within 12 days, or risk rejection of its current application.

The decision came after a nearly two-hour hearing Thursday. Summit had requested an indefinite suspension following a new state law that bans the use of eminent domain for CO2 pipelines.

Landowners opposed to the project urged the commission to reject the application outright.

Commissioner Kristie Fiegen proposed the two-week deadline. Commissioner Chris Nelson pushed for immediate dismissal, but was outvoted 2-1. The commission will revisit the issue at its next meeting.
