PIERRE, S.D. (KELO) — The South Dakota Supreme Court has ruled in favor of the city of Tea, rejecting a challenge from a landowner who claimed a $61,623 special assessment was unconstitutional.
The assessment was part of a city project to improve access to Interstate 29, with costs partially covered by fees to properties that directly benefited.
KJD LLC sued after being assessed, but the state’s high court unanimously upheld a lower court ruling, stating the city’s findings were presumed correct and KJD failed to provide sufficient evidence to challenge them.
