AG: State Initiatives Must Be Sponsored By SD Citizens

(Pierre, SD) — South Dakota Attorney General Marty Jackley says any state proposals must be made by South Dakota residents. Jackley sent his opinion to Secretary of State Monae Johnson on Monday. While acknowledging there are no state laws on the books that prohibit out-of-state residents from sponsoring a proposal, Jackley said in his letter he came to his conclusion after “reviewing the relevant state law and our Constitution.” The issue came up after a Florida resident proposed a measure requiring a “non-denominational” prayer be read at South Dakota schools to begin each school day.
