Dismissal Of Wrongful Death Lawsuit Upheld

(Bismarck, ND) — The dismissal of a wrongful death lawsuit stemming from a deadly road washout is being upheld. Caused by heavy rain, the washout killed two drivers at the Standing Rock Reservation in 2019. Family members of the victims filed a wrongful death lawsuit against the Bureau of Indian Affairs, alleging that they failed to maintain a road culvert. Last year, a judge dismissed the lawsuit on the grounds that the Bureau of Indian Affairs “had no mandatory rules, regulations, policies or procedures” making them responsible for maintenance of the culvert. The ruling was upheld by an appeals court late last week.
