New Trial Appealed For Cassandra Black Elk

(Bismarck, ND) — The new trial granted to a woman who pled guilty to the abuse of a child who died in her care is being appealed. Cassandra Black Elk says her public defender told her to plead guilty before the autopsy results of the three-week-old had been disclosed. It showed the infant suffered an unexplained sudden death. Judge Daniel Borgen vacated Black Elk’s 18 month sentence in February and ordered a new trial. Burleigh County prosecutors are appealing that decision.
