State Supreme Court Says Fargo Cannot Ban Home Gun Sales

(Bismarck, ND) — The North Dakota Supreme Court says Fargo does not have the authority to ban city residents from selling guns out of their homes. In an opinion published Thursday, the high court upheld a lower court’s decision to dismiss a lawsuit brought by Fargo against state lawmakers. The city’s lawsuit would have blocked a state bill prohibiting cities from banning gun sales in homes. In its opinion, the North Dakota Supreme Court said the state legislature has the right to create and define powers for home rule cities, and that Fargo’s argument that it has the power to make laws to protect its residents is misplaced.
