Supreme Court Wetlands Ruling Has North Dakota Implications

(Washington, D.C.) — North Dakota leaders are praising yesterday’s ruling by the U.S. Supreme Court on federal wetlands regulation. The majority of the High Court that wetlands can be regulated under the Clean Water Act if they have a “continuous surface connection” to larger regulated bodies of water. Yesterday’s ruling came from a case in Idaho in 2007 where a family was barred from building a home near a lake by the EPA. It will impact ongoing court cases, including one in North Dakota, over new Biden administration regulations on which Waters of the United States are protected under the Clean Water Act.
