Federal Judge Rules Against Minnehaha County Petition Policy

(Pierre, SD) — Chief United States District Judge for South Dakota Roberto Lange is issuing a preliminary injunction to prevent the county from enforcing “designated areas” for petition circulation. The healthcare advocacy group Dakotans For Health sued Minnehaha County officials on May 10th, looking to stop the county from enforcing a policy of prohibiting petition circulations near county buildings. Dakotans for Health is circulating petitions to place an amendment on the 2024 ballot to legalize abortion in South Dakota. Rick Weiland, who’s with the group, calls it a “win for direct democracy.” Lange’s order prevents the county from enforcing any part of their new ‘Limited Use Policy’ passed by county commissioners unanimously back in May.
