Supreme Court Decision on ‘Stand Your Ground’ Law

(Pierre, SD) — The South Dakota Supreme Court says the state’s “Stand Your Ground” law can’t be applied retroactively. The ruling was made Thursday in review of a 2019 Sioux Falls murder case. Ramon Smith was found guilty of second-degree murder and three counts of aggravated assault in June of 2019. He was sentenced to life in prison without parole after claiming self-defense. The justices made a unanimous decision, disagreeing with Smith’s attorney who argued the immunity law was a procedural law to dismiss the charges.
